Terms of Use

1. Accessing and Using the Application

You acknowledge that the availability of the Application is dependent on the third-party platform from which you download the Application (for example, Google Play Store). Each of these platforms may have its own terms and conditions for the downloading, installation and use of the Application, and you agree that it is your responsibility to ensure compliance with such terms and conditions.

In accessing and using this Application, you must not:

• Post, send or otherwise transmit to or through the Application any unlawful, infringing, harmful, harassing, defamatory, threatening, vulgar, sexually explicit, racist, violent, immoral, religiously offensive, hateful or otherwise objectionable material of any kind, any material that exploits children or is invasive of or in breach of another person's privacy or other rights or any material that openbaselabs in its sole discretion does not wish posted or transmitted on the Application.
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights, such as rights of privacy and publicity, of others.
• Upload or otherwise make available files that contain images or other material protected by intellectual property laws, including without limitation copyright, patents, designs or trademark laws and rights of confidentiality, publicity and privacy unless you own or control the rights thereto or have received all necessary authorizations to do the same.
• Misrepresent your identity or affiliation in any way.
• Use the Application in a manner that would violate these Terms of Use or other section(s) of the Application.
• Assist or permit any persons in engaging in any of the activities described above.

We may, at any time without prior notice, restrict, block, suspend or disable your access to all or some parts of the Application or Services, and/or edit or remove any content within the Application including any material which in openbaselabs’ reasonable opinion may give rise to a breach, or be in violation of these Terms of Use or any applicable law, or which we consider in our discretion might be otherwise offensive, harmful or objectionable.

2. Eligibility

You are not authorised to access or use the Service or systems it resides on unless all of the following are true:

• You are at least 13 years of age.
• You are not a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction, for example, you do not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or face any other similar prohibition.
• You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.
• You have never been convicted of a felony or indictable offence, or any crime of similar severity, or any crime involving violence.

3. Privacy

Your privacy matters to us. You can learn how your information is handled when you use our Services by reading our Privacy Policy.

4. Subscriptions

Dual Chat Pro Scan offers paid auto-renewable subscription plans. Subscription options may include weekly and annual plans. Prices and available subscription options are displayed within the app at the time of purchase.

Billing & Renewal

Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions

You can manage or cancel your subscription at any time through your account settings on the platform from which the subscription was purchased.

• For Apple devices: subscriptions are managed through your Apple ID settings.
• For Android devices: subscriptions are managed through your Google Play Store account settings.

Cancellation & Refunds

If you cancel a subscription, the cancellation will take effect at the end of the current billing period. You will continue to have access to the subscription features until the subscription expires. Refunds are handled according to the policies of the platform from which the subscription was purchased.

Platform Availability

Subscriptions are platform-specific and cannot be transferred between different operating systems or app stores.

5. Intellectual Property Rights

We respect intellectual property rights and ask you to do the same. As a condition of your access to and use of the Services, you agree not to use the Services to infringe on any intellectual property rights. We reserve the right, with or without notice, at any time and in our sole discretion to block access to and/or terminate the accounts of any user who infringes or is alleged to infringe any copyrights or other intellectual property rights.

6. Term and Termination

6.1. Compliance with the Terms

Failure to comply with the Dual Chat Pro Scan Terms of Service may result in a temporary or a permanent ban from Dual Chat Pro Scan or some of its services. In such instances, you might lose the benefits of our service and we will not compensate you for this loss.

6.2. Unilateral Termination

openbaselabs can decide to stop offering subscriptions at any time, including in response to unforeseen circumstances beyond our control, or to comply with a legal requirement; in this case we will cancel your subscription and refund the prorated portion of any prepaid subscription fee equal to the remaining unused term of the subscription.

7. Third Party Services

The Service may contain advertisements and promotions offered by third parties and links to other web sites or resources. openbaselabs is not responsible for the availability, or lack of availability, of such external websites or resources. If you choose to interact with the third parties made available through our Service, such party's terms will govern their relationship with you. openbaselabs is not responsible or liable for such third parties' terms or actions.

8. Disclaimers

DUAL CHAT PRO SCAN PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. DUAL CHAT PRO SCAN DOES NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICE WILL BE ACCURATE.

DUAL CHAT PRO SCAN TAKES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER MEMBER OR THIRD PARTY POSTS, SENDS OR RECEIVES THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DUAL CHAT PRO SCAN, OPENBASELABS, EMPLOYEES, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, (II) THE CONDUCT OR CONTENT OF OTHER MEMBERS OR THIRD PARTIES ON, THROUGH, OR FOLLOWING USE OF THE SERVICE; OR (III) UNAUTHORISED ACCESS, USE OR ALTERATION OF YOUR CONTENT, EVEN IF DUAL CHAT PRO SCAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL DUAL CHAT PRO SCAN’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF THE AMOUNT PAID, IF ANY, BY YOU TO DUAL CHAT PRO SCAN FOR THE SERVICE AND USD100 WHILE YOU HAVE AN ACCOUNT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

10. General Terms

1. Severability: Even if a court finds any section of the Terms invalid or unenforceable, the rest of the Terms still apply.
2. No Waiver: Even if we do not enforce, or we delay enforcement of, the Terms against you, we have not waived our enforcement rights.
3. Assignment or Transfer: You cannot assign or transfer your rights or obligations under this agreement to someone else without our written permission. We can transfer our rights and obligations to you without your permission unless we are acquired by or merge with another company, sell one of the Services, or otherwise.
4. Complete Agreement: These Terms are an entire, exclusive agreement between openbaselabs and you regarding the Services, and these Terms supersede and replace any prior agreements between openbaselabs and you regarding the Services. We may revise these Terms from time to time. If the revision in our sole discretion is material, we will notify you via banner notice across its page or other appropriate means. By continuing to access or use the Services after those revisions become effective, you agree to be bound by revised Terms.
